S. INSURANCE<\/td><\/tr><tr><td>9 SETTLEMENT OF DISPUTES<\/td><td>19 GUARANTEE FUND<\/td><\/tr><tr><td>10 CORRESPONDENCE<\/td><td>20 VARIOUS<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">1. <strong>SUBJECT OF THE AGREEMENT<\/strong><\/h3>\n\n\n\n<p>MKT undertakes to render services to the Client in the fields of the organization of tourist trips,&nbsp; but also single services like reservation of hotels, transfers, excursions, tickets, and to render other services (hereinafter \u2013 \u201cServices\u201d), whereas Client undertakes to pay the Services, according to the provisions of the present Terms and Conditions Agreement (hereinafter \u2013 \u201cContract\u201d).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. <strong>INTERACTION BETWEEN THE PARTIES<\/strong><\/h3>\n\n\n\n<p>There are 2 ways of booking tours\/services on our web site.<\/p>\n\n\n\n<p>a) There are tours\/services that Client can book and pay directly from our web site. With this type of booking Client has to pay 100% in advance. For annulation policy and different types of insurances please see the relevant paragraph of this contract. After receiving payment from Client, MKT Viaggi sends an invoice and vouchers. For execution time see the relevant paragraph of this contract.<\/p>\n\n\n\n<p>b) On our web site you can find also tours\/services on request. That means that client has to send us a booking form request with services requested, their quantity and quality specifications, dates of tour\/service, etc. (hereinafter \u2013 \u201cRequest\u201d).<\/p>\n\n\n\n<p>Besides Client must specify all the necessary data concerning the physical person (-s) supposed to be the Service consumer(-s) (hereinafter \u2013 \u201cthe physical person\u201d) (including the personal data, address, and other necessary information).<\/p>\n\n\n\n<p>At the receipt of an appropriate Request MKT will send an Invoice for payment to Client within 3 (three) days. After that client pays the invoice in terms indicated below (see paragraph PAYMENTS).<\/p>\n\n\n\n<p>MKT can deny Services ordered by Client in the Request form sending a refuse notification. If there was already payment from the Client, MKT Viaggi would make a full refund with the same method of payment.<\/p>\n\n\n\n<p>In case of non-observance of the terms indicated in the paragraph PAYMENTS of the present Contract by Client, MKT will not be held liable for delays in Service providing and\/or impossibility to render the Services. MKT will be held liable to provide the Services only after the complete payment of the issued Invoice under the terms of the present Contract.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. PAYMENTS<\/h3>\n\n\n\n<p><strong><strong>Contract Price and method of settlements<\/strong><\/strong><\/p>\n\n\n\n<p>The costs of the Services provided under the present Contract are indicated in the Invoice.<\/p>\n\n\n\n<p>The approximate prices for concrete types of Services provided under the present Contract are represented in the promotional materials of MKT, the prices will be adjusted by MKT at the moment of the receipt of the Request from the Client. In case of differences between the approximate prices indicated in the promotional materials and the ones adjusted by MKT, the adjusted MKT prices at the date of reservation will have the priority and they will be afterwards indicated in the Invoice.<\/p>\n\n\n\n<p>The client can refuse further booking if he is not satisfied with adjusted prices. In this regard the Client musts notify MKT in writing of his choice to accept or withdraw from the booking within two days of receiving the proposal.<\/p>\n\n\n\n<p>The Client has to transfer to MKT an advance payment of 30% from the cost of the Services indicated in the Invoice within 2 (two) days from the Receipt of the Invoice.<\/p>\n\n\n\n<p>If the MKT\u2019s Invoice or Notification contains other conditions and payment terms for the Services, the conditions and terms indicated in the Invoice or Notification will be effective.&nbsp; (example, some services o tours have to be paid 100% at the moment of booking).<\/p>\n\n\n\n<p>The remaining cost of the Services equal to 70% of the total amount indicated in the Invoice will be paid by the Client to MKT at least 15 (fifteen) days before the beginning of the reserved Services.<\/p>\n\n\n\n<p>If the Request is sent less than 15 (fifteen) days before the beginning of Services, the Client has to pay immediately 100% of the Services indicated in the MKT Invoice.<\/p>\n\n\n\n<p>The payment obligation will be considered done at the receipt of the money by MKT or at the moment of the entry of the money to the account of MKT. The cost of Services indicated in the Invoice does not include the money transfer expenses. (Should arrive the whole sum as indicated in invoice, all charges for bank transfer are to be paid by the Client.) The Services can be paid, at the mutual agreement of the Parties, in any way permitted by the Laws (bank transfer, credit\/debit card, etc).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. <strong>CONFIRMATION OF BOOKING\/VOUCHER<\/strong><\/h3>\n\n\n\n<p>MKT will send vouchers for the booked Services within 3 (three) days from the receipt of the amounts. Please read with attention all additional info we put in voucher.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. <strong>CANCELLATION \/ CHANGES<\/strong><\/h3>\n\n\n\n<p>Client can renounce the delivery of the Services indicated in the Invoice only at the conditions described below.<\/p>\n\n\n\n<p>Changes of any characteristics of the delivered Services (including the number of the people consuming the Services) as compared with those indicated in the Invoice and\/or a total renunciation of confirmed Services as indicated in the Invoice are possible only against the payment of penalties by Client, depending on the date when MKT receives the information upon the changes and\/or total renunciation (unless other penalties are specified on our site for specific tour\/service o in MKT Notification send by email*):<\/p>\n\n\n\n<p>-30-20 days before beginning of confirmed Services\/tour package: 20% of the Services cost,<\/p>\n\n\n\n<p>-20-15 days before beginning of confirmed Services\/tour package: 50% of the Services cost,<\/p>\n\n\n\n<p>-14-0 days before beginning of confirmed Services\/tour package: 100% of the Services cost.<\/p>\n\n\n\n<p>The penalties are to be paid within 2 (two) days after MKT receives a Notification from Client concerning the introduction of the pertaining changes into the delivered Services characteristics and\/or complete renunciation of confirmed Services.<\/p>\n\n\n\n<p>The introduction of any changes in confirmed Services (including the number of persons consuming the Services) as compared with those indicated in the Invoice and\/or total renunciation of booked Services become effective only if the Client sends a pertaining Notification to MKT or cancels service\/tour on our web site.<\/p>\n\n\n\n<p><strong>*Important note<\/strong> -&nbsp; For some tours on our website, in the description, the Client can find penalties different that are indicated above, in that case the penalties indicated on the website for a specific tour\/service (or in notification that we will send by mail at the moment of booking)&nbsp; will be effective.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. <strong>LIABILITY OF THE PARTIES<\/strong>&nbsp;<\/h3>\n\n\n\n<p>MKT will not be held liable for the impossibility to perform the Services, undue quality of the provided Services caused by the reasons not depending on MKT, such as the reasons related to the actions of the third parties that are the direct executors of the Services, and also the reasons related to wars, menace of war, economic reasons in the host country and in the departure country, acts of terrorism, strikes, calamities, technical failures of the aircrafts, flight cancellations o delays, bus, ferryboat, train and other transport cancellations, hotel overbooking, lock down or red zone during pandemic, in case of violation by a tourist of customs and border formalities and rules of travel and baggage transportation, any reasons related to covid or other pandemic (ex.the client fell ill with covid, was quarantined, a pandemic occurred in the client's country, was not allowed to land due to high temperature, etc.), etc. <\/p>\n\n\n\n<p>In case of the breach of the obligations deriving from the present Contract, the Party at fault has to pay all the damages caused by the breach.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. INSURANCE<\/h3>\n\n\n\n<p>MKT will not be held liable for damages to health and\/or goods of the persons consuming the Services. Insurance is not included in our tours. So we inform Client that it is strongly recommended to make insurance policies, to cover from events which may affect the performance of the holiday. These include trip cancellation, medical expense coverage, early returns, loss or damage to luggage, covid 19 insurance (assistance, medical expenses, extension of stay even in the case of Covid-19, etc.), etc. More information please see on our site (Useful links - Insurance).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. <strong>Reasons for the Exoneration of the Parties from Liabilities<\/strong> &nbsp;&nbsp;<\/h3>\n\n\n\n<p>The Parties will be exonerated from their liabilities for the total or partial breach of the Contract obligations, if they are caused by the force majeure circumstances, such as: <\/p>\n\n\n\n<p>- the emergency and superior force conditions, such as earthquakes, hurricanes, typhoons, tsunamis, wars, important mass riots; lock down or red zone during pandemic; <\/p>\n\n\n\n<p>- Unilateral government deeds adoption, coming into force after the present Contract becomes effective; <\/p>\n\n\n\n<p>- International agreements and international organizations documents adoption after the entrance into force of the present Contract; <\/p>\n\n\n\n<p>- Other circumstances. <\/p>\n\n\n\n<p>As practice shows, during such events as a volcanic eruption, a sudden pandemic, lock down, etc. suppliers make or do not make a refund of the sum already paid, basing on the laws adopted by the government of a particular country at the time of force majeure. It often happens that suppliers have the right to issue a voucher for the paid amount, which must be used for a next trip within a certain period. Only after receiving the paid amount or a voucher from the supplier, MKT, in turn, can make a refund to the client or provide a voucher.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. <strong>SETTLEMENT OF DISPUTES<\/strong><\/h3>\n\n\n\n<p>All claims must be made in writing. Our company will consider all complaints and give an answer within the time limit established by law. Complaints submitted more than 15 days after the end of the tour \/ service will not be considered.<\/p>\n\n\n\n<p>All the disputes under the Contract or somehow connected with it are to be settled through amicable negotiations. If the agreement can\u2019t be reached, the dispute will be considered by a competent court &nbsp;the Arbitration tribunal of Genoa, Italy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10. <strong>Correspondence and Notifications between the Parties<\/strong><\/h3>\n\n\n\n<p>The Parties carry out the correspondence by email and\/o fax.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11. <strong>BOOKING OF TOURS \/ PACKAGES<\/strong><\/h3>\n\n\n\n<p><strong><strong>Package 74ter<\/strong><\/strong><\/p>\n\n\n\n<p>Package 74ter is a tourist package with combination of at least two different types of tourist services, such as: 1. passenger transport; 2. accommodation that is not an integral part of passenger transport and is not intended for residential purposes, or for long-term language courses; 3. the rental of cars, other vehicles or motor vehicles and requiring a category A driving license; 4. any other tourist service that is not an integral part of one of the tourist services referred to in numbers 1), 2) or 3), and is not a financial or insurance service, for the purposes of the same trip or vacation, if yes check at least one of the following conditions:<\/p>\n\n\n\n<p>1) these services are combined by a single professional, even at the request of the traveler or in accordance with his \/ her selection, before a single contract is concluded for all services;<\/p>\n\n\n\n<p>2) these services, even if concluded with separate contracts with individual suppliers, are:<\/p>\n\n\n\n<p>2.1) purchased at a single point of sale and selected before the traveler agrees the payment;<\/p>\n\n\n\n<p>2.2) offered, sold or billed at a flat rate or global price;<\/p>\n\n\n\n<p>2.3) advertised or sold under the name \"package\" or similar name;<\/p>\n\n\n\n<p>2.4) combined after the conclusion of a contract with which the professional allows the traveler to choose from a selection of different types of tourist services or purchased from distinct professionals.<\/p>\n\n\n\n<p><strong>Single services<\/strong><\/p>\n\n\n\n<p>Contracts relating to the offer of the transport service only, the accommodation service only, or any other separate tourist service, cannot be configured as a negotiating case of travel organization or tourist package, do not enjoy the protections provided in favor of travelers by Legislative Decree 62\/2018 (which implemented the EU Directive 2015\/2302). The conditions of payments, cancellations and complaints in this MKT contract we also apply for individual services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">12. <strong>BOOKING OF&nbsp; EXCURSIONS \/ EXPERIENCES<\/strong><\/h3>\n\n\n\n<p>Prices for Christmas, New Year, Easter, some local holidays are subject to clarification.<\/p>\n\n\n\n<p>Entrance tickets to museums are paid additionally. Entrance fees are generally paid locally, however there are a number of museums where reservations are recommended due to long queues (eg Uffizi Gallery, Vatican Museums, Pisa tower, etc).<\/p>\n\n\n\n<p>Organization of sightseeing tours is possible on any day of the week. Visits to museums should be planned according to their opening days and hours.<\/p>\n\n\n\n<p>The tour is considered confirmed only after you receive written confirmation from MKT. Confirmation will be sent within 24 hours (on weekdays) Group rates - on request.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. <strong>BOOKING OF TRANSFER<\/strong><\/h3>\n\n\n\n<p>When booking a transfer from a hotel or railway station, after 15 minutes of waiting from the booked time - every hour of waiting is paid additionally by the tourist himself on the spot to the driver. In any case, you need to warn about being late. If customers have not contacted the driver in case of being late, the driver leaves after 15 minutes of waiting, without prior warning.<\/p>\n\n\n\n<p>MKT will not be held liable for the impossibility to perform the Services caused by the reasons not depending on MKT like client is late for time of pick up for his personal reasons, or there are traffic jams, accidents on the roads due to which the vehicle cannot arrive at the destination on time, etc.<\/p>\n\n\n\n<p>When booking a transfer from the airport, after an hour of waiting at the airport from the time specified in the flight data when booking - each hour of waiting is paid additionally by the tourist himself on the spot to the driver. In any case, you need to warn about being late.<\/p>\n\n\n\n<p>In the case of a large amount of luggage that was not indicated during the booking and does not fit into the vehicle, the client bears the cost of their transportation.<\/p>\n\n\n\n<p>The price is valid for transfers from 07.00 to 22.00. Outside of this time, 20% will need to be paid additionally to the specified amount. On Sundays and holidays, there is also a surcharge of 20%.<\/p>\n\n\n\n<p>Prices for Christmas, New Years, Easter and some local holidays need to be checked.<\/p>\n\n\n\n<p>If customers cannot find a driver at the meeting point specified in the transfer voucher, the Client musts immediately contact our support team (the phone number is specified in voucher) and report the problem. If the client does not report the delay, the transport company has the right to confirm no-show, which means that it is impossible to provide compensation.<\/p>\n\n\n\n<p>The transport company reserves the right not to contact the client if tourists do not appear at the time specified in voucher. The responsibility for being late is on the Cleint. In the event that customers leave the meeting point with the driver without first calling MKT support, they are considered to have cancelled the transfer unilaterally and no compensation will be provided.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">14. <strong>BOOKING OF PRIVATE VILLAS, APARTMENTS<\/strong><\/h3>\n\n\n\n<p>The Client has to pay city tax, security deposit on the spot (in case of damage to property), respect the check in and check out times - indicated in the voucher, leave the villa in a clean condition upon check-out (kitchenette, garbage, etc.)<\/p>\n\n\n\n<p>We also bring you to your attention - Descriptions of our villas and their photos are provided either by the owner or by a local real estate agency.<\/p>\n\n\n\n<p>MKT Viaggi will not be held liable in the event that the customer, who has read the information, watched photos and descriptions sent to him by e-mail, does not like the property upon arrival. Since everyone has different tastes and a different impression of the structure, such claims are not accepted.<\/p>\n\n\n\n<p>If there are people with disabilities or people with reduced mobility, it should be borne in mind that some properties, even if they have a bedroom or a bathroom suitable for use by people with disabilities, are still rural houses and may have associated restrictions and, possibly, architectural barriers inside the structure. In addition, if you have children, it is recommended to carefully study the descriptions and photographs of the properties and request additional information from the MKT Viaggi in order to ascertain the suitability of the selected housing. MKT Viaggi is not liable in cases where the client has not properly studied the descriptions, has not specified the data of interest.<\/p>\n\n\n\n<p>Should the client, upon arrival or the next day, find that the property has serious inconsistencies in comparison with its descriptions, or if problems arise that cannot be resolved or minimized on site, please contact us immediately, or the local real estate agency or the owner of the villa (apartment). MKT Viaggi will make every effort to resolve the problem as quickly as possible and ensure a pleasant stay for guests in the ordered property.<\/p>\n\n\n\n<p>MKT Viaggi reserves the right to carry out an on-site check, including while vacationers are at the house, through its representative to clarify the reasons for the claims and identify potential incorrect actions on the part of the owner, both outside and inside the residential facility. All problems must be resolved directly on the spot with the owners of the villa \/ apartment through MKT Viaggi or the local real estate agency o owners of the house.<\/p>\n\n\n\n<p>No compensation will be awarded if the client makes a claim to MKT Viaggi after the end of their stay.<\/p>\n\n\n\n<p>In addition, compensation is not provided for customers in the event of their eviction from the house at the request of the owners due to no communication of the presence of additional people in addition to the declared number of guests or the presence of animals (the number of additional guests and the presence of animals must always be reported and agreed with MKT Viaggi and confirmed by the owners of the property) or if the Client doesn\u2019t pay the security deposit, which must be paid on arrival.<\/p>\n\n\n\n<p>There is no compensation for clients leaving the house in case of discrepancies or problems without prior written notice to MKT Viaggi, it is also not provided in case of early departure of clients from the ordered house in the absence of good reason or serious inconvenience, as well as without prior referral to MKT Viaggi written explanatory notice or in case of inattentive acquaintance with the description of the villa or apartment and the discovery of conditions that do not satisfy the Client. Refunds also cannot be provided to guests who have left the property without giving MKT Viaggi an opportunity to investigate and verify the reasons for the claims.<\/p>\n\n\n\n<p>A refund of the amount paid will only be made if the owner of the villa \/ apartment or the local real estate agency approves the claim and agrees to pay the refund. Only after receiving the approved amount from the owner of the structure MKT will make a refund, if it wasn\u2019t already made on site. MKT Viaggi does not accept as justifiable claims such factors as the atmosphere, insect bites, power, gas or water interruptions caused by the actions of the authorities and the government.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">15. <strong>CITY TAX (for hotels, villas, apartments, etc)<\/strong><\/h3>\n\n\n\n<p>The prices do not include the tourist tax. Each municipality has the right to proceed with its application. In many municipalities of Italy it is already applied such as Florence, Rome and Venice, etc.etc., further information on the measures applied can be provided at the time of booking. Payment of the tax is required upon arrival at the accommodation structure, unless otherwise specified.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">16. <strong>TRAVELING IN THE PERIOD OF COVID<\/strong><\/h3>\n\n\n\n<p>All updated information about where and how you can travel please see here<\/p>\n\n\n\n<p>\u2022&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; www.viaggiaresicuri.it<\/p>\n\n\n\n<p>\u2022&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; reopen.europa.eu<\/p>\n\n\n\n<p>\u2022&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; traveldoc.aero<\/p>\n\n\n\n<p>Before leaving your country you are strongly recommended to get Covid-19 insurance coverage. (assistance, medical expenses, extension of stay in the event of Covid-19, etc).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">17. <strong>Documents for the trip&nbsp; - Passports \/ Visas \/ Health Requirements<\/strong><\/h3>\n\n\n\n<p>MKT is available to inform you about the updated documentation requirements, necessary for the tours sold on our web site. It is the Client's duty to ensure that he is in compliance with the passport, visa, health requirements of the country of destination or transit (even if only for a flight change). Many countries require that the passport is valid for a period of (minimum) six months from the date of arrival in that country. MKT accepts no responsibility in the event that departure or entry to customers is denied due to failure to comply with the above.<\/p>\n\n\n\n<p>At the request of the client, MKT can issue an invitation to obtain a visa at the Italian consulate in the country where the client lives, but only if the hotel is booked through MKT and totally paid.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">18. <strong>Third party liability policy<\/strong><\/h3>\n\n\n\n<p>To guarantee the exact fulfillment of the obligations undertaken towards customers, MKT has stipulated a specific insurance policy with Allianz, policy no. 112367603, pursuant to art. 14 L.R. n. 07 of 31\/03\/2003.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">19. <strong>GUARANTEE FUND<\/strong><\/h3>\n\n\n\n<p>The tourist package organization contracts are assisted by suitable guarantees given by the organizer and by the intermediary travel agent who, in the event of insolvency or bankruptcy of the intermediary or the organizer, guarantee the refund of the sum paid for the purchase of the tourist package and the immediate return of the traveller (if the tourist package includes transport).
